Terms of Use for Locate Us
Agreement
These Terms of Use ("Agreement") govern your access to and use of Locate Us (the "App"), provided by Pixster Studio ("we," "our," "us"). By downloading, installing, or otherwise using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree with these Terms, please do not use the App.
We may amend these Terms from time to time. If material changes are made that affect your rights or obligations, we will notify you via reasonable means, such as an in-app notification or email. Your continued use of the App after changes have been posted will signify your acceptance of the updated terms. If you do not agree with the updated terms, you must discontinue using the App.
If you have any questions or concerns about these Terms, please feel free to contact us. Do not use the App until your questions have been answered and you agree to abide by these Terms.
Acceptance of Terms
By accessing and using the App, you agree to comply with and be legally bound by the terms and conditions of this Agreement. If you do not agree, you must immediately discontinue using the App.
We may modify these Terms at any time. You will be notified when significant changes are made, and your continued use of the App will constitute acceptance of the updated Terms.
Account Registration
To use certain features of the App, you may be required to create an account. You must provide accurate and complete registration information, including your name, email address, phone number, and other necessary details. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Please notify us immediately if you suspect any unauthorized use of your account.
Grant of License
Subject to your compliance with these Terms, Locate Us grants you a non-exclusive, revocable, non-sublicensable, non-transferable license to use the App solely for your personal, non-commercial purposes. You agree not to distribute, lease, sublicense, sell, or otherwise transfer any rights to the App.
Use of Location Data and Permissions
To provide its core features, the App collects and processes precise location data. This is necessary for tracking the location of your family members. You consent to this data collection by using the App. You may withdraw your consent at any time by disabling location services on your device, but this may limit the functionality of the App. The App will only process location data in accordance with your privacy settings, and any shared data is protected according to our Privacy Policy.
Background Location. Because Locate Us is a continuous family location-sharing service, the App requests permission to access your location in the background — including when the App is closed or not in active use — so that your Circle members can see your current location and so the App can send location-based alerts at any time. By granting this permission, you consent to the App accessing and sharing your location in the background for these purposes. You may revoke background location permission at any time through your device settings; doing so will limit the App's ability to share your location or deliver location-based alerts while the App is not open, but will not prevent other use of the App.
Notifications. The App requests permission to send you notifications, including location-based alerts, Circle updates, and account-related messages, which are also saved to your in-app notification history. You may disable notifications at any time through your device settings, though doing so may cause you to miss time-sensitive alerts.
In-App Notifications
The App generates in-app notifications, such as location-based alerts and account updates. These notifications are saved in a notification history within the App so that you can view past notifications at any time. You may not be able to disable certain notifications that are essential to the App's core functionality (such as location alerts), but you may be able to manage other notification preferences through the App's settings.
Chat and Communication Features (Individual & Circle Chat)
The App offers individual and group ("Circle") text chat features that allow you to communicate with other users, including members of your Circle. Chat messages are end-to-end encrypted, meaning the content of your messages can only be read by you and the intended recipient(s); we do not have access to the decrypted content of your messages. Encrypted messages are stored via Firebase solely to enable delivery, device syncing, and chat history.
You are solely responsible for the content of the messages you send and for your conduct within any chat or Circle. You agree not to use the chat features to:
Harass, threaten, abuse, or defame any other user;
Send unlawful, obscene, defamatory, or infringing content;
Send unsolicited advertising, spam, or promotional messages;
Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
Share another user's personal information without their consent.
Because chat messages are end-to-end encrypted, we are unable to review, filter, or moderate the content of messages sent between users. If you experience harassment, abuse, or other misconduct through the chat features, please remove or block the offending user through the App's tools and, where appropriate, report the conduct to us at feedback@pixsterstudio.com. We may suspend or terminate the accounts of users who violate this section based on user reports and other available information, even though we cannot view message content directly.
SOS and Crash Alert
The App includes an SOS feature and an automatic Crash Alert feature. When you activate SOS, or when the App detects a potential vehicle crash, the App sends an alert — which may include your location at the time of the alert — solely to the members of the Circle(s) you belong to. These features are intended to inform and alert your Circle members only; they do not notify emergency services, and you remain responsible for contacting emergency services directly if needed. You acknowledge that the Crash Alert feature relies on your device's sensors and connectivity and may not detect every crash or may occasionally be triggered without an actual crash having occurred.
Geofence Check-In
The App allows you or another member of your Circle to define a geofenced area, including a temporary geofence created for a specific, one-time occasion, and to select which Circle member(s) should be notified when a designated user enters or exits that area. A temporary geofence is intended for single use only: it automatically becomes inactive after the one entry/exit event (or set of events) it was created for has occurred, or once it expires, whichever comes first, and will not generate further notifications after that point unless you create a new geofence. By using this feature, you consent to the App monitoring the relevant location relative to the defined geofence(s) and notifying the selected Circle member(s) of entry/exit events. You are responsible for the geofences you create and for selecting appropriate recipients for geofence notifications. Temporary geofences remain active only for the period you set and will stop generating notifications once they expire, are used, or are deleted.
Privacy
Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. The Privacy Policy also includes details about data collection, use, storage, third-party sharing, and your rights under GDPR and CCPA. Please review the Privacy Policy carefully before using the App.
Third-Party Services
The App may include third-party services, such as payment processors, analytics providers, or cloud storage services, to enhance its functionality. These services are subject to their respective terms of service and privacy policies. By using these features, you consent to the collection and use of your information by these third-party services.
Payment and Subscriptions
YOU KNOWINGLY AND FREELY ASSUME ALL RISK WHEN USING THE SERVICES, INCLUDING BUT NOT LIMITED TO THE POSSIBILITY THAT LOCATION DATA MAY BE DELAYED, INACCURATE, OR UNAVAILABLE. YOU, ON BEHALF OF YOURSELF, YOUR PERSONAL REPRESENTATIVES AND YOUR HEIRS, HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND AND INDEMNIFY LOCATEUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, REPRESENTATIVES, SUBLICENSEES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, ACTIONS OR LOSSES FOR PROPERTY DAMAGE, PERSONAL INJURY, WRONGFUL DEATH, EMOTIONAL DISTRESS, LOSS OF SERVICES OR OTHER DAMAGES OR HARM, WHETHER TO YOU OR TO THIRD PARTIES, WHICH MAY RESULT FROM YOUR USE OF THE SERVICES.
Data Retention and Deletion
We retain your personal data, including your notification history, end-to-end encrypted chat messages, and SOS, Crash Alert, and geofence check-in data, for as long as you maintain an active account with the App. You may delete your account and request the removal of your personal data at any time by following the instructions in the App. Upon deletion, we will erase your personal data, including your notification history, chat messages, and SOS/Crash Alert/geofence data, except when we are required to retain it for legal reasons or compliance.
Restrictions on Use
You agree not to:
Use the App for any unlawful, harmful, or illegal purposes.
Interfere with or disrupt the App's functionality or servers.
Attempt to reverse-engineer, decompile, disassemble, or modify the App in any way.
Use any automated tools or software to scrape or harvest content from the App.
Use the individual or Circle chat features to harass, threaten, spam, or send unlawful content to other users, as further described in Section 6.
Misuse the SOS, Crash Alert, or Geofence Check-In features, including by creating false SOS or Crash alerts, or by creating geofences to monitor a person without their knowledge or consent where such knowledge or consent is required by law.
Updates to the App
We may periodically release updates or modifications to the App, including adding new features or improving performance. These updates may be automatically installed without prior notice to you. You agree to receive these updates and acknowledge that you may need to review and accept updated Terms of Use when new versions are released. We are not obligated to support previous versions of the App once an update has been made available.
Termination
We may suspend or terminate your access to the App if you violate any of the terms outlined in this Agreement. Upon termination, you must cease using the App and delete any copies of it. You may also terminate your account by deleting it through the App's settings.
Limitation of Liability
The App is provided on an "as-is" and "as-available" basis. We do not warrant that the App will meet your expectations, be uninterrupted, or be free of errors. To the maximum extent permitted by law, Pixster Studio shall not be liable for any damages, including loss of profits, data, or business, arising from your use of or inability to use the App.
Indemnification
You agree to indemnify, defend, and hold harmless Pixster Studio and its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising out of your use of the App or violation of these Terms.
Data Protection and Privacy Rights
As a user, you have certain rights under data protection laws such as GDPR and CCPA, including:
Right to Access: You have the right to request information about the personal data we hold about you.
Right to Rectification: You can amend certain personal data associated with your account if it is inaccurate or incomplete.
Right to Erasure: You can request the deletion of your account and all associated personal data.
Right to Restrict Processing: In certain circumstances, you can request that we limit the processing of your personal data.
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format.
Right to Object: You can object to the processing of your personal data at any time.

Governing Law
These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Pixster Studio is based, without regard to its conflict of law principles.
