This End-User License Agreement (including any Supplemental Terms, as applicable) ("EULA") governs your use of "Daily Affirmations App : I am" (the "App"), published by Pixster Studio. By installing or otherwise using the App, you: (a) agree to be bound by this EULA; (b) represent and warrant that you own or control the device on which the App will be installed; and (c) represent and warrant that you have the right, authority, and capacity to enter into this EULA. This EULA also applies to any updates, supplements, or services related to the App that are not provided under a separate agreement. If you do not agree to this EULA, do not install or use the App. We may amend these terms from time to time; if changes are material, we will notify you by reasonable means, which may include an in-app notice. Continued use of the App after such changes constitutes acceptance. Use of the App is subject to our Privacy Policy, which is incorporated into this EULA by reference.
You must be 13 years of age or older to install or use the App. If you are between 13 and 18 years of age, please have a parent or legal guardian review this EULA with you. NOTICE TO PARENTS AND GUARDIANS: By allowing your child to download and use the App, you agree to this EULA on your child's behalf and are responsible for supervising their use of the App. If you are the parent or guardian of a child under 13 and believe they are using the App, please contact us at feedback@pixsterstudio.com.
Subject to your compliance with this EULA, we grant you a non-exclusive, revocable, non-sublicensable, non-transferable license to download, install, and use the current generally available version of the App on a single device you own or control, solely for your personal, non-commercial use.
You may not rent, sell, lease, sublicense, distribute, assign, copy (other than a single backup copy), or otherwise transfer the App, or use it for the benefit of any third party. You may not use any automated process to interfere with the App's operation, attempt to breach its security, reverse-engineer, decompile, disassemble, or otherwise tamper with the App, or create derivative works from it.
The App provides affirmation content and related tools, including audio, practice, and reader modes; custom themes; custom affirmations; soothing audio in male or female voices; breathing exercises; random affirmations; daily reminders; and a home-screen affirmations widget. Features and content may change over time, and we may add, modify, or remove features at our discretion.
To provide certain features, the App requests specific device permissions, each used solely for the purpose described below (see our Privacy Policy for further detail):
Internet / Network Access — to connect to our cloud services, process purchases, and load images and audio content.
Network State — to detect connectivity and support offline use.
Vibrate — to provide haptic feedback for affirmations and reminders.
Schedule Exact Alarm — to deliver reminders at the exact time you select.
Post Notifications — to show reminders, app messages, and media-playback notifications.
Receive Boot Completed — to restore your scheduled reminders after a device restart.
Foreground Service / Media Playback — to keep audio you started playing while you use other apps, with playback controls in the notification shade.
Record Audio (Microphone) — requested only if and when you choose to record your own voice within the App. Before the system permission prompt appears, the App will show you an in-app explanation of why this access is needed.
You may decline or later revoke any permission through your device settings; doing so may limit the corresponding feature (for example, reminders will not fire without notification/alarm permissions, and voice recording will not work without microphone access).
Certain features of the App may be offered on a subscription basis (e.g., daily, weekly, monthly, or yearly), or as one-time in-app purchases. Payments are processed by Google Play or the Apple App Store, and purchase/subscription status may be managed through our subscription-management partner, Qonversion. Free trials, where offered, may be cancelled at any time before the end of the trial period through your iTunes or Google Play account settings; otherwise the trial will automatically convert into a paid subscription. You can cancel a subscription at any time via your app-store account settings; cancellation takes effect at the end of the current billing period. All purchases are subject to the refund policies of the applicable app store.
You are solely responsible for any custom affirmations, recordings, or other content you create or import into the App ("User Content"). You represent that you have the right to use such content and that it does not violate the rights of any third party. You retain ownership of your User Content; we do not access, use, or share User Content except as needed to operate the features you use (for example, storing it on your device or, where applicable, syncing it to your account).
The App does not require account creation to use its core features. Where data is held on your behalf by us or our processors (e.g. subscription records via Qonversion, analytics identifiers via Firebase), you may request deletion at any time via the App's Settings screen (where available), by emailing feedback@pixsterstudio.com as described in our Privacy Policy.
If you enable reminders, the App will send you local notifications at times you choose. We may also send you service-related notifications (such as those relating to your subscription or app updates) through Firebase Cloud Messaging. You can manage or disable notifications at any time through the App's settings or your device's system settings.
The App integrates with third-party service providers, including Firebase (analytics, crash reporting, notifications) and Qonversion (subscription management). These providers' use of information is governed by their own privacy policies in addition to ours. We are not responsible for the practices of these third parties beyond our instructions to them.
The App, including its design, text, images, audio, affirmation content, code, and documentation, is the property of Pixster Studio or its licensors and is protected by applicable intellectual property laws. All rights not expressly granted to you are reserved.
If the App allows you to submit or share content, you agree not to submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, hateful, sexually explicit, or that infringes the rights of others. We may remove such content and may suspend or terminate accounts that repeatedly violate this policy.
To the extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any affirmation content will produce particular results. The App is not a substitute for professional medical or mental-health advice, diagnosis, or treatment; if you are experiencing a mental-health crisis, please contact a qualified professional or local emergency services.
To the extent permitted by applicable law, Pixster Studio shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of, or inability to use, the App. Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, for the App in the twelve months preceding the claim.
You agree to indemnify and hold harmless Pixster Studio, its affiliates, officers, and employees from any third-party claims, damages, or costs (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of this EULA.
Your rights under this EULA terminate automatically if you fail to comply with its terms. We may suspend or terminate your access to the App at any time, with or without cause. Upon termination, you must cease all use of the App and delete any copies in your possession.
The App and related technology are subject to applicable export control laws and regulations. You agree to comply with such laws when downloading or using the App.
If any provision of this EULA is found unenforceable, the remaining provisions will remain in full force and effect. No failure to enforce any right under this EULA constitutes a waiver of that right. Any cause of action arising out of or related to the App must be commenced within three (3) years after the cause of action accrues, or it is permanently barred.
